The move, according to Berry Appleman and Lynden Melmed of Leiden, is "simply basic logic." While international students should demonstrate their plan to leave the country, he stressed, US consular officers should not draw conclusions about the applicant's future prospects.

Several groups that promote for foreign education were pleased with the decision, according to media sources. Consular officers should be able to examine the "inherent difference" between a "fresh F-1 visa applicant" and a "more established short-term visa applicant," according to Jill Allen Murray, NAFSA's Deputy Executive Director of Public Policy.

NAFSA had made certain critical recommendations to the Department of State, according to Jill, including the restoration of "useful distinctions to the residency abroad requirement for F visa holders." F-1 visa applicants will no longer be "penalised for not having the ties of property, job, and continuity of life" that a short-term visa applicant would be expected to and capable of having with the help of the new guidance.

The Presidents' Alliance on Higher Education and Immigration's executive director, Miriam Feldblum, expressed her support for the action, reiterating the Presidents' Alliance's position on the topic. She praised Biden's administration for "reigniting international student mobility" for taking the initiative.

"The context of the stay abroad requirement for student visas inherently differs from the situation for B guest visas or short-term visas," according to the revised guidance. Furthermore, the Act specifies that a student's natural conditions and circumstances do not prohibit him or her from acquiring a visa.

Furthermore, the Act specifies that a student's natural conditions and circumstances do not prohibit him or her from acquiring a visa. According to media sources, a student without any ties to property, job, or a sense of continuity is natural and frequent, as most students are single, unemployed, and without property, and are often at a crossroads in their lives.

According to the guidance, adjudication for a student visa becomes more difficult because students require more time to complete their education than other international travellers. As a result, when evaluating a candidate, it is important to evaluate the student's current aspirations rather than what might happen when they finish their programmes.

Furthermore, US consular personnel should be pleased with the applicant's current intent, that is, their intention to leave the US after completing their studies at the time of applying for a visa. Furthermore, realise that the fact that the objective is open to change, and is therefore likely to change, should not be used to refuse a student's visa. Furthermore, the intent to leave does not apply to students who are forced to return to their home country; rather, it refers to students who plan to depart the United States after completing their programmes.

The policy shift comes at a time when US universities are concerned that stringent immigration and visa restrictions are causing overseas students to lose interest in applying to their institutions.
