Delhi HC Permits Admission to AYUSH PG Courses Without NEET from 2022


New Delhi: The Delhi High Court has agreed to grant admissions to postgraduate AYUSH courses without the NEET score. 

On April 6, 2022, the Delhi High Court sought a response from the central government, the National Commission for Homoeopathy and the NTA among others on a plea by a private homoeopathic medical college challenging the vires of the National Commission for Homoeopathy Act, 2020, to the extent that mandates NEET PG for admission to postgraduate AYUSH courses.

The division bench consisted of Acting Chief Justice Vipin Sanghi and Justice Navin Chawla, who issued the notice, allowing the institute to grant admission in its postgraduate courses in AYUSH for the academic session 2021-22 without considering the NEET-PG score, in case surplus seats are left.

The bench has decided to take a call on this matter on July 19, 2022.

Earlier, in 2020, the National Commission for Homoeopathy Act, 2020, was brought into force. Sections 14 and 16 of the Act have made it compulsory for the candidates to crack the NEET exam to be eligible to take admission in UG and PG in alternative medicine courses including homoeopathy. 

However, the respective sections came into effect only in July 2021.

On the behalf of G.D. Memorial Homoeopathic College, the instant petition was filed by Advocate Kundan Kumar Mishra. The homoeopathic college is the only private medical college in Bihar that offers post-graduate courses in homoeopathy. 

The petition challenges the vires of Section 16 of the NCH Act for being arbitrary, discriminatory and violative of Articles 14,19(1) (g) and 21 of the Constitution and also considering that there has been no regulation in force under which the alleged section has the responsibility of controlling admissions.

According to the plea, there has been no set regulation to date that has been prescribed under the NCH Act 2020 for setting up the standard of marks required to pursue PG courses in the country, resulting in a chaotic situation for the students and the petitioner. 

The plea also revealed that the counselling session for the academic year 2021-22 has already commenced for UG courses and for PG courses. 

There were no suggestions or objections invited from any stakeholders before undertaking the exercise of passing the impugned notifications on the introduction of the NEET exam in AYUSH courses.

Further, the plea seeks cancellation of the information bulletin issued for academic session 2021-2022 to the extent that it instructs to grant admission to postgraduate courses in homoeopathy based on the NEET-PG score. 

The Delhi High Court has also seized a batch of petitions objecting to the introduction of the NEET exam for undertaking admission to the UG level in both homoeopathy and modern medicine courses. 

Even the notices were issued in March in this regard and that the colleges received the approval to admit students at the UG level to homoeopathy courses without taking NEET scores into account in case seats remained vacant.

Meanwhile, there are similar issues pending before the Karnataka High Court and the Madhya Pradesh High Court, wherein the same relief has been granted.
